Mediation

Priya’s experience previously as a Solicitor and in recent years as a Barrister means that parties benefit from a multi-faceted, practical and cost-effective approach to dispute resolution when instructing her to act as Mediator.

Priya’s practical approach to settlement often results in both parties gaining an outcome they could not have achieved at court. She will not unnecessarily drag out the mediation if there is no likelihood of settlement, however, she has a high success rate in both representing parties at and conducting mediations.

Mediation is by far the most common method of Alternative Dispute Resolution. In the UK, mediation has a success rate of over 80% meaning that 4 out of 5 cases involved in mediation settle either at the mediation or shortly after.  It is a flexible process conducted confidentially in which a neutral person (the Mediator) actively assists the parties in working towards a negotiated agreement of a dispute or difference, with the parties in ultimate control of the decision to settle and the terms of resolution. The Mediator’s role is to merely accommodate the parties in reaching settlement. Importantly, mediation settlements are not concerned with determining liability or assessing the legal merits of the case. Instead, the parties, with the assistance of the Mediator, can reach an agreed solution which is tailored to their real needs and interests.

Mediation is a private and confidential process, avoiding the stress and trauma that litigation can sometimes involve, especially in cases where individuals may be required to give evidence in Court.
