Background:

Tom has a depth of experience beyond his level of call in claims on behalf of children for damages and declaratory relief under the Human Rights Act 1998 following applications by local authorities to revoke placement orders and freeing orders.

He appears frequently in the High Court in a wide range of hearings relating to applications made under the freestanding jurisdiction of section 7(1)(a) of the Human Rights Act 1998 and applications made within proceedings pursuant to section 7(1)(b) and has succeeded in securing significant awards in damages on behalf of the children he represents.

Given his parallel civil practice, Tom is fully conversant with the civil procedure and able confidently to deal with issues regarding costs liability, costs budgeting hearings, debarral orders and relief from sanctions and the administration of any award in damages, which regularly arise given that such claims are quasi-administrative in nature.

Tom will gladly undertake advisory work in this area in relation to the merits of any claim, the substantive procedure, quantum and costs. He can provide draft declarations and written submissions as required and within tight timescales. Further, Tom is able to advise on the best way to hold or administer any award of damages in the best possible way for the child involved.
